The New York Department of Environmental Conservation, which is cracking down on sales of outdoor wood boilers (OWBs) that don't meet the agency's new emissions standards, gave consumers an unexpected three more months to purchase non-complaint models back in April.
Now the DEC is getting sued for that decision by the American Lung Association and Environmental Advocates of New York, according to the Times Union:
A lawsuit filed by Environmental Advocates of New York and the American Lung Association in New York seeks to force DEC to abandon a last-minute emergency decision to extend an April 15 deadline for the sale of non-compliant wood boilers through July 14. "This rule was developed for three years, so the industry has had plenty of notice on this deadline, and to assert they will be stuck with inventory in quite ridiculous," said Ross Gould, air and energy program director of Environmental Advocates.
